1. Person in Charge of Processing

This privacy policy applies to the website operated by Expérience Equinox (referred to in this policy as "we," "us," or "our"). We are subject to Quebec Law 25 (An Act to modernize legislative provisions as regards the protection of personal information, S.Q. 2021, c. 25) and are committed to handling your personal information responsibly and transparently.

This policy explains what personal information we collect when you visit our website, why we collect it, who we share it with, how long we keep it, and what rights you have under Quebec Law 25.

2. Personal Information Collected

Depending on how you interact with our website, we may collect the following categories of personal information:

• Identification and contact information — your name, email address, phone number, and any other details you provide when filling out a contact or inquiry form.
• Device and technical identifiers — your IP address, browser type, operating system, device identifiers, and advertising identifiers collected automatically when you visit our site.
• Browsing behavior — pages you visit, time spent on each page, navigation paths, session duration, and interactions with page elements (clicks, scrolls, mouse movements).
• Approximate location — a general geographic location derived from your IP address (city or region level; not precise GPS coordinates).
• Communication data — messages you send us through our live chat tool or contact forms, including the content of those conversations.
• Newsletter subscription information — your email address and communication preferences when you subscribe to receive updates from us.
• Consent preferences — your cookie consent choices, recorded and stored by our consent management platform.

We do not knowingly collect personal information from individuals under the age of 14 without verifiable parental consent.

3. Purposes of Processing

We collect and use your personal information only for the purposes described below. For each purpose, we identify the legal basis under Quebec Law 25.

• Operating the website (Essential) — We use session data, security tokens, and consent preferences to make our website function correctly and to remember your cookie choices. This is necessary for the operation of the site and does not require your consent. This is handled by Moelleux (by Horizon-Cumulus), our consent management platform, which stores consent records in Quebec (OVH Beauharnois).
  Legal basis: Legitimate interest / operational necessity.
• Audience measurement and site improvement (Analytics) — We use Google Analytics 4 and Hotjar to understand how visitors use our site, which pages are most visited, and where we can improve the user experience. Google Analytics 4 collects device identifiers, IP address, pages visited, session duration, navigation behavior, and approximate location. Hotjar additionally records user sessions and generates heatmaps to visualize interactions. Both services transfer data to the United States.
  Legal basis: Your consent, which you may withdraw at any time.
• Advertising, remarketing, and lead tracking (Marketing) — We use Meta Pixel (Facebook), Google Ads / Conversion, and HubSpot to measure the effectiveness of our advertising campaigns, track conversions, serve targeted ads to people who have visited our site, and manage our sales leads. These services collect device identifiers, IP address, browsing behavior, advertising identifiers, and in some cases transaction data. HubSpot also collects form data and communication data for marketing automation. All three services transfer data to the United States.
  Legal basis: Your consent, which you may withdraw at any time.
• Live customer support (Functional) — We use Crisp Chat to offer you real-time chat support directly on our website. When you use the chat, Crisp collects your IP address, device identifiers, and the content of your conversation. Crisp is operated in France.
  Legal basis: Your consent for the activation of the chat widget; legitimate interest for responding to your support requests once initiated.
• Website typography and display (Functional) — We use Google Fonts and Adobe Fonts (Typekit) to render the typefaces used on our website. These services may collect your IP address and device identifiers when your browser requests font files. Both services transfer data to the United States.
  Legal basis: Your consent, which you may withdraw at any time.
• Newsletter communications — If you subscribe to our newsletter, we use your email address to send you updates, real estate news, and promotional content. You may unsubscribe at any time using the link included in every email.

• Responding to your inquiries — When you contact us through a form or by email, we use the information you provide solely to respond to your request.

4. Third Parties and Processors

The table below lists every third-party service active on our website, its purpose, its service category, and whether it involves a transfer of personal information outside Quebec.

We require all third-party processors to handle your personal information only for the purposes we specify and in a manner consistent with applicable privacy law.

5. Transfers Outside Quebec

Several of the third-party services we use transfer personal information outside Quebec, as required by section 17 of Quebec Law 25. Before authorizing any such transfer, we assess whether the destination jurisdiction offers an adequate level of protection for your personal information, and we put contractual safeguards in place where required.

The following transfers are currently in place:

• Google Analytics 4 (United States) — Your device identifiers, IP address, browsing behavior, and approximate location are processed by Google LLC in the United States. Google participates in the EU-U.S. Data Privacy Framework and uses standard contractual clauses for international transfers. A Privacy Impact Assessment (PIA) has been or will be conducted prior to activating this service, as required by Quebec Law 25.
• Hotjar (United States) — Session recordings and heatmap data, including your IP address and browsing behavior, are processed by Hotjar Ltd. in the United States. Hotjar relies on standard contractual clauses as a transfer safeguard. A PIA has been or will be conducted prior to activating this service.
• Meta Pixel (Facebook) (United States) — Conversion and remarketing data, including advertising identifiers and browsing behavior, are processed by Meta Platforms, Inc. in the United States. Meta relies on standard contractual clauses. A PIA has been or will be conducted prior to activating this service.
• Google Ads / Conversion (United States) — Advertising conversion data is processed by Google LLC in the United States under the same safeguards as Google Analytics 4. A PIA has been or will be conducted prior to activating this service.
• HubSpot (United States) — Lead and marketing automation data, including form submissions and communication data, are processed by HubSpot, Inc. in the United States. HubSpot relies on standard contractual clauses. A PIA has been or will be conducted prior to activating this service.
• Crisp Chat (France) — Chat conversation data and IP addresses are processed by Crisp IM SAS in France. France is a member of the European Union and subject to the General Data Protection Regulation (GDPR), which provides a level of protection recognized as adequate for many international transfer purposes. A PIA has been or will be conducted prior to activating this service.
• Google Fonts (United States) — Your IP address and device identifiers are transmitted to Google LLC servers in the United States when your browser loads font files. Google relies on standard contractual clauses.
• Adobe Fonts (Typekit) (United States) — Your IP address and device identifiers are transmitted to Adobe Inc. servers in the United States when your browser loads font files. Adobe relies on standard contractual clauses.

Our website hosting and consent management infrastructure is operated by Horizon-Cumulus (Joliette, Quebec) and hosted at OVH Beauharnois, Quebec. No personal information processed by these core systems leaves Quebec.

6. Retention Period

We retain your personal information only for as long as necessary to fulfill the purposes described in this policy, or as required by law. The table below summarizes our retention practices by data type.

Once the applicable retention period expires, personal information is securely deleted or anonymized so that it can no longer be associated with you.

7. Your Rights

Under Quebec Law 25, you have the following rights with respect to your personal information. To exercise any of these rights, please contact us using the information provided in Section 8.

• Right of access — You may request a copy of the personal information we hold about you, as well as information about how it is used and with whom it has been shared.
• Right of rectification — If any personal information we hold about you is inaccurate, incomplete, or ambiguous, you may ask us to correct it. If we have shared that information with third parties, we will notify them of the correction where feasible.
• Right of erasure (right to be forgotten) — You may ask us to delete personal information that was collected without a valid legal basis, that is no longer necessary for the purposes for which it was collected, or where you have withdrawn your consent and no other legal basis applies.
• Right to data portability — You may request that we provide you with the computerized personal information you have provided to us in a structured, commonly used technological format, so that you can transmit it to another organization.
• Right to withdraw consent — Where we rely on your consent as the legal basis for processing, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal. You can manage your cookie consent preferences at any time through the consent banner on our website.

We will respond to your request within 30 days of receipt, as required by Quebec Law 25. In complex cases, we may extend this period by an additional 30 days and will notify you accordingly.

If you are not satisfied with our response, or if you believe we are not handling your personal information in accordance with the law, you have the right to file a complaint with the Quebec Information Access Commission (CAI):
